What Is Probate?

Probate is a court process that occurs after a person dies. It calls for a court to validate the individual’s will (if they had one) and oversee the distribution of assets to their heirs. These assets may include money, property, accounts, investments, possessions, and more. Contrary to popular belief, having a will is not enough to stop the probate process from occurring. If there was a will, someone will be named to be the “executor” of the estate and will have to carry out the many responsibilities required to resolve probate. With no will, this person is called the “administrator” and typically has the same duties. 

What Does The Probate Process Look Like In Alabama?

Once the court has been notified of the death (which usually involves submitting the death certificate), the estate executor or personal representative will be named. This person is responsible for:

  • Filing a petition for probate 
  • Locating and managing the assets
  • Valuing and appraising the assets
  • Paying taxes on behalf of the estate
  • Notifying creditors and paying outstanding debts

  • Distributing assets to their intended heirs (if there was a will) or according to the Alabama laws of intestate succession (if there was no will)

All of this usually takes a year or more to be completed and for probate to be completely resolved and closed. This means that the heirs will also not be able to obtain their inheritances for this length of time.
