What Is Probate?

Probate is a court process that occurs after a person dies. It calls for a court to validate the individual’s will (if they had one) and oversee the distribution of assets to their heirs. These assets may include money, property, accounts, investments, possessions, and more. Contrary to popular belief, having a will is not enough to stop the probate process from occurring. If there was a will, someone will be named to be the “executor” of the estate and will have to carry out the many responsibilities required to resolve probate. With no will, this person is called the “administrator” and typically has the same duties.

What Does The Probate Process Look Like In Alabama?

Once the court has been notified of the death (which usually involves submitting the death certificate), the estate executor or personal representative will be named. This person is responsible for:

  • Submitting the will
  • Filing a petition for probate
  • Locating and managing the assets
  • Valuing and appraising the assets
  • Paying taxes on behalf of the estate
  • Notifying creditors and paying outstanding debts
  • Paying funeral costs
  • Distributing assets to their intended heirs (if there was a will) or according to the Alabama laws of intestate succession (if there was no will)
  • And much more!

All of this usually takes a year or more to be completed and for probate to be completely resolved and closed. This means that the heirs will also not be able to obtain their inheritances for this length of time.

Why Do I Need To Hire An Attorney To Resolve Probate?

If you are the executor or personal representative of your loved one’s estate, all of the above duties fall on you. This can be extremely stressful to go through, even if your case is simple and there are no complications along the way. However, there are a number of events that can cause a roadblock to the resolution of your case, including:

  • The validity of the will being questioned
  • The interpretation of the will being questioned
  • The proper heir being debated
  • Disputes started over how assets should be divided
  • An heir or beneficiary who is a minor
  • The assets include real estate

These can all lead to probate costing more and lasting longer, which no one wants. You can rest assured that there is no complication that our Mobile probate lawyers haven’t seen, and no case that has been too complex for us to resolve successfully. It is much more beneficial to let us guide you from the start, rather than only getting involved after the case gets messy. If your process has already become messy, don’t panic! We can still offer our personalized services in order to get you a favorable outcome.
